Canada and European Food Regulation – Biscuit enriched with Vitamins and Minerals. Please advise on permitted vitamins and minerals for biscuits & criteria and dosage of vitamins and minerals required to make “enriched” claim for biscuits.

Canada

According to Food and Drug Regulations (FDR), only food products in the current provisions for addition of vitamins and minerals are permitted to be fortified with vitamins and minerals. Biscuit is not listed in the table of Foods to Which Vitamins, Minerals Nutrients and Amino Acids May or Must be Added {D.03.002, FDR}.

 

EU

According to Amending Directive 2002/46/EC of the European Parliament and of Council and Regulation (EC) No 1925/2006 of the European Parliament and of the Council as regards the lists of vitamin and minerals and their forms that can be added to foods, including food supplements (Commission Regulation (EC) No 1170/2009), the vitamin and mineral substances which may be added to foods are listed in Annex III as attached.

According to Nutrition and Health Claims Made on Foods (Regulation (EC) No 1924/2006), claims related to the addition of vitamins and minerals such as ‘with …’, ‘restored …’, ‘added …’, or ‘enriched …’ should be subject to the conditions set for the claim ‘source of …’.” A claim that a food is a source of vitamins and/or minerals, and any claim likely to have the same meaning for the consumer, may only be made where the product contains at least a significant amount as defined in Annex I of Nutrition Labelling for Foodstuffs (Council Directive 90/496/EEC). Please refer to the attachment “Annex I – Vitamins and minerals which may be declared and their recommended daily allowances (RDAs)”.
